Welcome to Korean Cosmetics! The terms “we”, “us” and “our” refer to Korean Cosmetics. Korean Cosmetics operates this store and website, including all related information, content, features, tools, products and services, to provide you with a personalised shopping experience (the “Services”). Korean Cosmetics is powered by Shopify, which enables us to provide the Services to you.

Korean Cosmetics reserves the right to accept or reject any order at our sole discretion and for any reason.
Your order is not considered accepted until Korean Cosmetics confirms receipt and acceptance of your order. Payment must be successfully received and processed before an order is accepted.
Please review your order carefully before submitting it, as cancellation may not be possible once an order has been accepted.
If we reject, modify or cancel an order, we will attempt to notify you using the email address, billing address and/or telephone number provided when the order was placed.
Returns and exchanges are governed exclusively by our Return Policy.
You represent and warrant that all purchases are intended for personal or household use and not for resale, export or commercial distribution.
SECTION 4 – PRICING AND BILLING
Prices, discounts and promotions may change without prior notice.
The price charged for a product or service will be the price in effect at the time the order is placed and will be confirmed in your order confirmation email.
All prices shown include VAT, customs duties and import fees. Shipping costs are shown separately at checkout.
Prices shown in our online store may differ from prices offered in physical stores, other online stores, marketplaces or third-party retailers.
We may occasionally offer promotions governed by separate promotional terms. In the event of a conflict between promotional terms and these Terms, the promotional terms shall prevail.

SECTION 5 – SHIPPING AND DELIVERY
We aim to deliver all orders within the delivery times stated in our Shipping Policy. Delivery times are estimates and may occasionally be affected by circumstances beyond our control, such as carrier delays, customs handling, weather conditions or force majeure. If your delivery is delayed, we will help you and keep you informed.
The risk for the products passes to you when you, or someone you have designated, receive the products. If a parcel is lost or damaged in transit, we will send you a replacement or refund the amount.
Your rights under applicable consumer law in the event of delayed or missing delivery are not limited by these Terms.
SECTION 6 – INTELLECTUAL PROPERTY

The Korean Cosmetics name, logo, product names, service names, designs and slogans are trademarks of Korean Cosmetics or its licensors. Shopify's name, logo, product names, service names, designs and slogans are trademarks of Shopify. All other trademarks displayed on the Services belong to their respective owners.

The Services may provide access to third-party tools that we neither monitor nor control.

Korean Cosmetics is powered by Shopify, which enables us to provide the Services to you.
However, all purchases made through our store are transactions directly between you and Korean Cosmetics.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale, purchase, product, service, dispute, refund, return, warranty claim or other transaction between you and Korean Cosmetics.
To the fullest extent permitted by law, you release Shopify and its affiliates from any claims, damages, liabilities, costs or expenses arising from or related to your transactions with Korean Cosmetics.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, TIMELY OR ERROR-FREE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
SECTION 16 – LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOREAN COSMETICS, ITS AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS AND SHOPIFY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES.
THIS INCLUDES, WITHOUT LIMITATION:
• LOSS OF PROFITS;
• LOSS OF REVENUE;
• LOSS OF SAVINGS;
• LOSS OF DATA;
• BUSINESS INTERRUPTION;
• REPLACEMENT COSTS; OR
• ANY OTHER COMMERCIAL DAMAGES OR LOSSES,
WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES.
SECTION 17 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless Korean Cosmetics, Shopify and their affiliates, directors, officers, employees, agents, contractors, licensors and service providers from and against any claims, liabilities, damages, losses, costs or expenses, including reasonable legal fees, arising out of:
(i) your breach of these Terms of Service;
(ii) your violation of any applicable law or regulation; or
(iii) your use of the Services.
We will notify you of any claim subject to indemnification and may assume control of the defence and settlement of such claim at your expense, provided that we will not settle any claim requiring non-monetary obligations from you without your prior consent, which shall not be unreasonably withheld.

They supersede all prior or contemporaneous agreements, communications, negotiations and proposals, whether oral or written, between you and Korean Cosmetics, including any previous versions of these Terms of Service.
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

You may not assign, transfer, delegate or otherwise dispose of these Terms of Service or any of your rights or obligations under them without our prior written consent.
Any attempted assignment in violation of this provision shall be null and void.
We may assign, transfer, delegate or otherwise dispose of these Terms of Service and any of our rights or obligations without restriction and without notice to you.

These Terms of Service and any separate agreements under which we provide Services shall be governed by and construed in accordance with the laws of Sweden.
Any dispute arising out of or relating to these Terms of Service, the Services or any transaction with Korean Cosmetics shall be subject to the jurisdiction of the courts of Sweden.
Nothing in these Terms shall limit any mandatory consumer rights or protections available under applicable consumer protection laws.
